… the Conseil de la justice administrative has the power to investigate the conduct of members of the administrative tribunals under its jurisdiction.

Functions of the Conseil de la justice administrative

Pursuant to the Act respecting administrative justice (chapter J-3), the Conseil de la justice administrative fulfills the following functions :

  • Receives and examines any complaint lodged against a member of the Tribunal administratif du Québec, the Tribunal administratif du travail, the Tribunal administratif des marchés financiers, the Bureau des présidents des conseils de discipline and a commissioner or a special clerk of the Régie du logement and recommends the appropriate penalty, when applicable;
  • Conducts an inquiry into the permanent disability of a member to hold the office of member or commissioner;
  • Conducts an inquiry into lapse in the exercise of an administrative office at the Tribunal administratif du Québec, the Tribunal administratif du travail, the Tribunal administratif des marchés financiers,  the Régie du logement or the Bureau des présidents des conseils de discipline;
  • Publishes annually in the Gazette officielle du Québec a list of the departments and bodies that make up the Administration and a list of the bodies which exercise adjudicative function within the meaning of section 178 of the Act respecting administrative justice;
  • Establish the code of ethics applicable to the members of the Tribunal administratif du Québec;
  • Reports to the Minister of Justice concerning all matters submitted by the latter concerning the administration of administrative justice.
